Calgary Sod Supply is an online retail brand operated by Direct Landscape Supply. By accessing this website, placing an order, requesting a delivery, or purchasing products through this website, you agree to the terms outlined below.
Product Information
We make every effort to ensure product descriptions, images, pricing, specifications, and availability are accurate. Product appearance, colour, texture, moisture content, and size may vary due to natural conditions, manufacturing tolerances, seasonal changes, and supplier availability.
Calgary Sod Supply reserves the right to correct pricing errors, product descriptions, and website content without notice.
Delivery Terms
Delivery dates requested by customers are preferred dates only and are not guaranteed. Weather conditions, supplier delays, equipment breakdowns, traffic conditions, road restrictions, and other circumstances beyond our control may impact delivery schedules.
If Calgary Sod Supply is unable to complete delivery on the requested date, we will contact the customer to arrange an alternative delivery date.
Customers are responsible for ensuring the delivery address is accurate, house numbers are clearly visible from the street, delivery access is safe and unobstructed, and placement instructions are accurate and clearly provided.
Delivery drivers retain sole discretion regarding final placement locations based on site conditions, safety concerns, vehicle limitations, overhead obstacles, underground utilities, access restrictions, and ground conditions.
Delivery Damage & Property Liability
Customers acknowledge that landscape material deliveries may be completed using heavy commercial vehicles, forklifts, Moffett equipment, loaders, and other machinery which may cause damage to surfaces, landscaping, underground infrastructure, or property.
While Calgary Sod Supply and its delivery partners make reasonable efforts to avoid damage, deliveries are completed at the customer's request and risk.
Calgary Sod Supply shall not be responsible for damage to driveways, sidewalks, curbs, aprons, paving stones, concrete, asphalt, exposed aggregate, stamped concrete, lawns, irrigation systems, landscaping, gardens, trees, shrubs, flower beds, underground utilities, septic systems, electrical lines, drainage systems, water lines, sprinkler systems, soft ground, rutting, settling, cracking, sinking, or surface displacement.
Customers are responsible for ensuring access routes and placement areas are suitable for heavy equipment and commercial delivery vehicles.
If a customer requests delivery beyond a standard driveway, curbside location, alley access point, or other standard delivery area, the customer accepts all risk associated with that request.
The delivery driver retains sole discretion to refuse any placement location that may create a safety concern, vehicle access issue, or risk of property damage.
By placing an order, the customer authorizes Calgary Sod Supply and its delivery partners to enter the property for the purpose of completing delivery and accepts all risks associated with the requested placement location.
Deemed Delivered
Orders are considered delivered once materials have been placed at the delivery location specified by the customer or deemed appropriate by the driver.
Once delivered, responsibility transfers to the customer. Calgary Sod Supply is not responsible for theft, vandalism, damage, weather exposure, freezing, drying out, contamination, deterioration, or movement of materials by third parties after delivery has been completed.
Sod Orders
Sod is a perishable product harvested specifically for customer orders.
Customers agree that sod should be installed as soon as possible after delivery or pickup and should not remain on pallets for extended periods.
No refunds, returns, or credits will be issued for sod damaged due to delayed installation, improper storage, improper watering, neglect, weather conditions, pet damage, insects, disease, or installation practices.
Bulk Materials
Bulk materials including soil, mulch, gravel, decorative rock, sand, and aggregates are natural products. Variations in colour, texture, moisture content, particle size, and composition are normal and do not constitute defects.
Customers are responsible for verifying measurements and ordering appropriate quantities. No refunds or credits will be issued for excess material ordered by the customer.
Limitation of Liability
To the maximum extent permitted by law, Calgary Sod Supply and its affiliates shall not be liable for any indirect, incidental, special, consequential, or economic damages arising from product use, product installation, delivery delays, product shortages, weather conditions, site access restrictions, customer measurement errors, third-party contractor actions, or customer-requested placement locations.
Liability shall be limited to the value of the products purchased.
Right to Refuse Service
Calgary Sod Supply reserves the right to refuse service, refuse delivery, cancel orders, or decline transactions at its sole discretion.
Governing Law
These terms shall be governed by and interpreted under the laws of the Province of Alberta and the laws of Canada applicable therein.
